Prize draw terms — working draft
Draft for legal and promoter approval — not live competition terms. This page records the current Cotswold prize-draw operating model in original wording. Checkout and live entry must remain disabled until every launch blocker listed below has been approved and the final terms have been signed off by Cotswold Partnership and its professional advisers.
1. Promoter
The proposed promoter is Cotswold Partnership Ltd, registered in England and Wales with company number 16323733. The published business address is Unit 4 Draycott Business Centre, Draycott, Moreton-in-Marsh, Gloucestershire, GL56 9JY. Contact: mathew@cotswoldpartnership.com.
2. Nature of the promotion
The launch mechanic is intended to be a chance-based prize draw, not a skill competition. Valid paid entries and valid free entries must enter the same eligible draw population and must not be treated differently by the winner-selection process.
The promotion must not open until the free-entry route and draw process satisfy the applicable Gambling Act 2005 requirements and the final customer-facing wording has been approved.
3. Launch prize
The staged launch prize is one award comprising both vehicles: 2006 Subaru Impreza WRX STI Type UK and 2011 Mitsubishi Lancer Evolution X FQ-300. The current product configuration does not provide for a lower-value cash substitute merely because fewer paid entries are received than expected.
Final vehicle identity, ownership, condition, roadworthiness, included equipment, imagery and any material exclusions must be verified before the draw is advertised as live.
4. Eligibility
The current launch configuration sets a minimum age of 18. The final permitted territory, residency test, excluded persons and any employee/family exclusions remain subject to promoter/legal approval and must be published before entry opens.
A winner may be required to provide proportionate evidence of identity, age and eligibility before the prize is released. Verification requirements must be stated before launch and applied consistently.
5. Paid entry route
The staged paid-entry price is £5.00 per entry, with a proposed campaign cap of 12,000 paid entries. The final per-person entry limit is not yet approved.
A payment attempt is not itself a valid entry. The final implementation must record an entry only after authoritative payment confirmation and must keep failed, cancelled, duplicated and refunded payment states auditable.
6. Free entry route
A genuine free-entry route is a launch requirement. It must be clearly and prominently presented alongside the paid route, use an approved normal-rate method, and feed valid entries into the same draw population without technical disadvantage.
Launch blocker: the final postal address, required entrant information, submission format, receipt deadline, validation rules, duplicate-entry policy and processing timetable have not yet been approved. Until those details are approved, the free-entry instructions must not be represented as complete.
7. Opening, closing and draw dates
Approved closing date: To be confirmed. Approved draw date: To be confirmed.
A live promotion must publish a clear closing date and draw timetable. Once live, the promoter should not change the closing date simply because fewer entries were received than expected. Any exceptional change must be legally permissible, necessary because of circumstances outside the promoter's control, communicated clearly and handled so existing entrants are not unfairly disadvantaged.
8. Entry validity and fair administration
Entries must comply with the published route, eligibility and entry-limit rules. Paid and free entries must be reconciled into a single auditable eligible population before the draw is sealed.
Deliberate identity fraud, multiple-account abuse, automated entry abuse or tampering may justify rejection or disqualification where the relevant rule was clearly stated in advance and the decision is supported by retained evidence. New disqualification rules must not be invented retrospectively.
9. Refunds, failed payments and invalid entries
Launch blocker: the final refund, partial-refund, chargeback, late-payment and invalid-entry policy requires promoter/legal approval. The technical system must reflect the approved policy and must not silently create or retain an eligible paid entry after its authoritative payment state no longer permits that entry.
10. Winner selection
The winner must be selected fairly at random from the sealed population of valid entries. The final draw must use a verifiably random computer process or another approved process with the independence and evidence required for a fair prize draw.
Launch blocker: the final draw method, evidence standard, observer requirements where applicable and production runbook remain subject to approval. A winner can be selected only after the exact eligible population is sealed and the approved draw time is reached.
11. Winner contact and verification
The final terms must state how and when a potential winner will be contacted, what evidence is needed to verify eligibility, how long the winner has to respond, and what happens after reasonable contact attempts fail. The promoter should make adequate attempts to contact the winner rather than relying on a single message or call.
12. Prize award and handover
The advertised prize should be awarded as described or, only where lawful and genuinely necessary, by a reasonable equivalent of similar nature and value. The prize must not be reduced to a percentage of ticket sales merely because the campaign generated less revenue than forecast.
Final collection/delivery arrangements, handover evidence, vehicle documents, insurance/tax responsibilities and the transfer point for risk and ownership must be approved and stated before launch. Where a prize will be delivered more than 30 days after closing, the terms must state when the winner will receive it.
13. Winner information and publicity
The promoter must be able to demonstrate that a valid award took place. Entrants must be told before entry how winner information will be published or made available and must be given the opportunity, where applicable, to object to publication or request that less information is published.
Participation in promotional photographs, video, interviews or wider publicity must be treated separately from the minimum information needed to evidence a valid award and must follow the approved privacy/publicity policy.
14. Privacy
Personal information may be processed only for the purposes and on the lawful bases stated in the applicable privacy notice, including entry administration, payment reconciliation, eligibility verification, draw evidence, prize fulfilment, complaints and legal obligations. Marketing consent must remain separate where consent is required.
15. Technical failures, cancellation and changes
A technical failure must not be used as a blanket right to disadvantage entrants or rewrite the promotion after entry has begun. Any suspension, correction or cancellation must follow the approved incident policy, preserve the entry/payment audit trail and comply with applicable promotional rules.
Material terms should only be changed after launch in exceptional circumstances and only where the change is permitted and entrants are treated fairly.
16. Complaints
Competition-related complaints may initially be sent to mathew@cotswoldpartnership.com. The final published terms must also contain the approved complaints procedure, response/escalation route and any applicable alternative dispute or regulator information.
17. Liability
The final liability wording must be proportionate and legally reviewed. Nothing in the terms should attempt to exclude liability that cannot lawfully be excluded or restrict a participant's statutory rights.
18. Governing law
The final governing-law and jurisdiction clause requires legal approval before launch. The promoter is an England and Wales company, but the clause must remain consistent with the final eligible territory and any mandatory consumer rights.
